'Adopt a Striker' with Statewide Super Survey Competition
Terms and Conditions of (“Terms and Conditions”)
1. Promotion name
Statewide Super ‘Adopt a Striker’ Survey Competition (“Promotion”).
2. Conditions of entry
a) Information about the Promotion and how to enter forms part of these Terms and Conditions. Entry into this Promotion is deemed acceptance of these Terms and Conditions by each entrant. Entries not made in accordance with these Terms and Conditions will be disqualified.
b) The promoter is Statewide Superannuation Pty Ltd ABN 62 008 099 223, RSE Licensee and Trustee of Statewide Superannuation Trust ABN 54 145 196 298 (“Promoter”), Level 11, 211 Victoria Square Adelaide SA 5000, telephone 1300 65 18 65 (“Fund”).
c) For the purposes of these Terms and Conditions, the Promoter includes all of its related and subsidiary companies, past, present and future officers, agents, representatives, employees and assigns.
d) Employees and their immediate families and agencies are not permitted to enter the Promotion.
e) Entry is free and open to residents of South Australia aged 18 and over and who are members of the Fund (“Entrant”) who enter the Promotion in the manner stipulated in these Terms and Conditions.
3. Duration of the Promotion
Entry into the Promotion opens at 12 am (ACST) 9.01.2017 and closes 12 pm (ACST) 16.01.2017 (“Promotional Period”).
4. The prize:
a) A prize of a WBBL Adelaide Striker shirt signed by the WBBL Adelaide Striker players valued at $250 (“Prize”)
b) The Prize may not be transferred or substituted, except at the Promoter's discretion. The Promoter reserves the right to substitute the Prize for a prize of equal or greater value due to Prize unavailability.
c) For the avoidance of doubt, the Prize does NOT include any spending money.
d) All additional costs not expressly stated, but which may be incurred in acceptance and use of the Prize, are the responsibility of the winner and companion/s (if any). Such additional costs include, but are not limited to, travel to and from Adelaide and accommodation.
e) Use of any vouchers issued as part of the Prize may be subject to prevailing prize supplier terms and conditions of use.
f) The Promoter shall not be liable for any costs associated with the Prize after delivery to the Prize winner.
5. How to enter
Entrants can enter in the following way:
a) Upon receipt of the ‘Adopt a Striker’ with Statewide Super Survey email, visit the URL provided and enter the required contact details.
b) Entrants will be required to provide their full name, phone number and a valid email address.
c) Entry is deemed to be automatic upon completion of the above conditions.
d) Employers can choose not to enter the competition by selecting not to participate in the prize draw.
e) Entries will be deemed to be accepted at the time of receipt of the completed online entry form by the Promoter and not at the time of transmission.
f) Entries must be received by the Promoter during the Promotional Period. The Promoter accepts no responsibility for late, lost or misdirected entries.
g) Any costs associated with accessing the electronic communication remain the responsibility of the Entrant and are dependent upon the Internet Service Provider used by the Entrant.
h) Entries not completed in accordance with these Terms and Conditions or received after the expiry of the Promotional Period will not be considered. The outcome of the draw is final and binding on every person who enters. No correspondence will be entered into by the Promoter.
i) Incomprehensible and incomplete entries will be deemed invalid.
j) The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, has engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or the Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type as described in this clause.
a) The electronic prize draws will take place at Statewide Super, 211 Victoria Square, Adelaide SA 5000 at 11:30 am (ACST) on Thursday 19.01.2017.
b) If the winners cannot be notified within 28 days an unclaimed prize draw will take place at Statewide Super, 211 Victoria Square, Adelaide SA 5000 at 11:30pm (ACST) on Thursday 16.02.2017.
7. Notification of winners
a) The winner/s will be notified by phone within one business day of the draw on Friday 20.01.2017.
b) In order to claim the Prize, the winner must confirm their desire to do so in writing by responding to an email from Statewide Super before 16.02.2017. If the winner fails to do this by the deadline, the winner will be deemed to have forfeited the Prize and an unclaimed Prize draw will take place.
c) Should an Entrant’s contact details change during the Promotional Period, it is the Entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
d) The Prize will be delivered within Australia only to the nominated prize delivery address specified in the winner’s entry.
e) The Promoter reserves the right to request winners to provide proof of identity; proof of residency at the nominated prize delivery address and or proof of entry validity in order to claim the Prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that the winner cannot provide suitable proof, the winner will forfeit the Prize in whole and no substitute will be offered to the winner by the Promoter.
f) Should an unclaimed Prize draw occur, the winner will be notified by phone or email within one business day of the Friday 17.02.2017.
g) The Prize must be taken as offered and is non-refundable, non-transferable and non-redeemable for cash or other goods or services.
h) Once the Prize has left the Promoter’s premises, the Promoter takes no responsibility for Prizes damaged, delayed or lost in transit.
i) Without limiting any other provision of these Terms and Conditions, it is a condition of accepting the Prize that the winner must comply with all the conditions of use of the Prize and the Prize supplier’s requirements; and may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
a) The Promoter is collecting Entrants’ personal information for the purpose of conducting and promoting this Promotion (including but not limited to determining and notifying winners).
c) Entrants’ personal information may be disclosed to State and Territory lottery and regulatory departments (as required) and winners’ names published as described under these Terms and Conditions and as required under the relevant lottery legislation (as applicable). A request to access, update or correct any personal information of an Entrant should be directed to the Promoter.
d) Each Entrant consents to the Promoter using an Entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
9. General Terms
a) The Promotion is conducted by the Promoter
b) To the maximum extent permitted by law, the Promoter shall not be liable for any claims, costs, expenses, personal injury, death, loss (including loss of opportunity) or damage whatsoever (including but not limited to indirect or consequential loss or damage) suffered, sustained or incurred (including but not limited to that arising as a result of any negligent act or omission) as a result of, or arising out of, or in any way connected with:
I. this Promotion (including participation or attempted participation in the Promotion by an Entrant);
II. the Prize (including use or attempted use of the Prize);
III. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
IV. any theft, unauthorised access or third party interference; or
V. any entry that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter).
c) The Promoter is not responsible for any incorrect or inaccurate information, either caused by the Entrant or by any of the equipment or programming associated with or utilised in this Promotion, or for any technical error, or any combination thereof, that may occur in the course of the administration of this Promotion.
d) If for any reason this Promotion is not capable of running as planned, including (but not limited to) due to infection by a computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any Entrant who tampers with the entry process, to take any action that may be available, and to cancel, terminate, modify or suspend the Promotion, subject to any direction given under any applicable laws or regulations.
e) The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
